House PVM/JUD Bills February 6th

These Bills need testimony for the joint committees of COMMITTEE ON PUBLIC SAFETY, VETERANS, & MILITARY AFFAIRS and COMMITTEE ON JUDICIARY.

 

HB 2710 RELATING TO PROTECTIVE ORDERS.

Permits a law enforcement officer to search a person convicted of violating certain temporary restraining orders or protective orders, including the person’s motor vehicle and the person’s residence, for firearms without obtaining a search warrant if the law enforcement officer has reason to believe acts of abuse, malicious property damage, or harassment by the person are imminent.  Specifies that a seized firearm shall not be used for a subsequent conviction if the original search lacked probable cause but authorizes law enforcement to maintain the firearm until the registered owner can prove the firearm will be safely stored.

HB 1600 RELATING TO FIREARMS.

Repeals provisions that allow the lending of certain firearms for use within the State for up to 15 days and for use outside the State for up to 75 days without being subject to a background check and other requirements under chapter 134, HRS.  Prohibits transferring the possession or ownership of any firearm to any person except as provided under chapter 134, HRS.

HB 1902 RELATING TO FIREARMS.

Extends the prohibition for large capacity magazines to all firearms, rather than just pistols.  Provides an exception to the prohibition for law enforcement agencies and duly authorized officers.

HB 2631 RELATING TO MENTAL HEALTH.

Requires the chief of police in a county issuing a firearm permit to conduct a mandatory review of an applicant’s mental health records.

HB 1615 RELATING TO FIREARMS.

Prohibits any person from possessing a loaded firearm while intoxicated, unless the person is in their own dwelling.  Violation is a petty misdemeanor.

HB 2736 RELATING TO FIREARMS AMMUNITION.

Requires the licensing of sellers of ammunition, and for the identification and proper permitting of purchasers or possessors of ammunition.  Regulates ammunition in the same manner that firearms are regulated.
